Facts: Plaintiff was a 50-year-old women who was knocked to the ground when an elevator door malfunctioned and the door did not automatically bounce back. The electronic eye failed to work, according to the plaintiff’s expert. The defense would have claimed that no problems were found with the door on subsequent inspection.

Injuries: Plaintiff suffered a torn rotator cuff that required surgery.

This matter settled after a jury had been selected.
