Distracted Driving Accident – Driver Dropping off Passenger Moves Car Before Passenger Fully Out of Car

This accident occurred November 15, 2005, as the 80-year old plaintiff was exiting the back seat of a car that his friend had driven. The driver-defendant had a history of reading stock market quotes/stories on his laptop that was in the front passenger seat, whenever he stopped at lights.
As the passenger was exiting the back seat of the car, the car moved forward and the passenger fell to the ground. The driver claimed that he heard the door close and started to move, while the passenger said he was only partially out of the car when the car started to move.
Injuries: Plaintiff suffered a left hip fracture requiring an open reduction and internal fixation. He was left with a shortened leg and need for a walker. He also had a left shoulder fracture dislocation that required a closed reduction.
