Motorcycle crash on New York highway – broken foot with surgery

The plaintiff was riding his motorcycle in the right lane of the Belt Parkway in Queens (three lanes in each direction). A middle lane car moved to its right and struck the biker.
The biker stayed upright despite suffering a fractured left foot and damage to the bike. He exited at next exit, where he jumped off the bike to his right – the wrong side, but he had no choice due to the injury to his left foot.
The defendant driver claimed that the plaintiff was riding between lanes, supported by testimony from a non-party driver in a following car.
The plaintiff countered that this wasn’t so, as the right lane was clear, which was the reason that the car wanted to move there. But even if it were accurate, the car driver still failed to use his mirrors to see the bike approaching, making him negligent.
Injuries: Broken foot with pins and screws.
The case settled for $220,000 when the parties appeared for jury selection in June 2013. Supreme Court, Queens County.
